Terms of Service – Wabble

These Terms of Service (“Terms”) govern your access to and use of the Wabble AI data visualization platform (the “Service”), operated by WebAir AI LLC (“WebAir AI”, “we”, “us”, or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

2. The Service

Wabble is a free, browser-based tool that uses artificial intelligence to transform data files (such as PDFs and CSVs) into interactive dashboards and visualizations. Files are processed in your browser or via our secure API endpoints and are not permanently stored on our servers.

3. License and Access

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal and commercial purposes, subject to these Terms. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload or transmit any content that is harmful, offensive, defamatory, or infringes on the rights of others.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the integrity or performance of the Service, including through automated access (bots, scrapers, etc.) beyond normal use.
• Circumvent or attempt to circumvent any security features or access controls.
• Misrepresent your identity or affiliation with any person or entity.

5. Your Content

You retain all rights to the data and files you upload to the Service (“Your Content”). By uploading Your Content, you grant us a limited license to process it solely for the purpose of providing the Service to you.

We do not claim ownership of Your Content and do not use it to train AI models. Your Content is processed transiently and is not stored after your session ends.

6. Intellectual Property

The Service, including its design, code, features, documentation, and branding, is the property of WebAir AI LLC and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

7. Voluntary Support Payments

Wabble is free to use. You may choose to make a voluntary contribution via our Support page. Payments are processed by Stripe. Voluntary contributions are non-refundable and do not entitle you to any additional features, services, or guarantees beyond the free Service.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any results generated by the AI will be accurate, complete, or suitable for any particular purpose. You are responsible for verifying any output before relying on it.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEBAIR AI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless WebAir AI LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may terminate or suspend your access to the Service at any time, for any reason, without prior notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nassau County, New York.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be effective upon posting to this page. The “Last Updated” date at the top indicates the most recent revision. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
